  • Claim Handling - Denial of Claim

I was parked and backed into by an individual insured by Safeco on January 26, 2015. The guy claimed he didn't see my car in the parking space. The police completed an incident report which clearly states he was at fault. I put the claim into Safeco, and at first they claimed they were unable to get in touch with the guy and would not process the claim until the did so. The adjuster's name is Stacey Crooks. These folks flat out refuse to get my 2013 Cadillac ATS repaired, so I will have to personally sue their insured for the repairs.

There is no rhyme or reason why Safeco, Stacey Crooks, should deny this claim. You cannot back into a parked car. The excuse that you cannot contact your insured is ridiculous. How long can that excuse be valid? I eventually went through my own insurance company who was absolutely fabulous. I already have the paperwork to file a small claims suit against the insured so that I can at least get my deductible back. The insured should definitely find a company that stands behind him because as of now, I'm going after bank accounts, homes, etc. to put liens against the insured.

Safeco has no business conducting business in the State of Florida if they won't honor a cut and dried claim. There's no reason to fight this --

No company will pay a third party claim without speaking to their insured first, regardless of a police report. If he is playing hard to get, they cannot do anything. There is no time limit for them to pursue the claim. You did the correct thing by going through your insurance and then they will subrogate against his insurance.
