I own a condo and know know why people hate working with condo associations when any kind of problem/or injury occurs! This should have been slam-dunk covered… I pay for my dog on a yearly basis and we have a dog area in the back-yard common area of our condo. We are expected to use the doggie-doo bags out back at all times. Our back area was “very” dark and they have sprinklers in the walkway of the common area (supposed to be leval with the walkway). Very early one morning my dog had to go out and go potty... It was very dark that particular evening and I was trying to hurry. My foot hit a broken sprinkler/or pipe (near the doggie bag station) and I flew to the ground. It was so dark I couldn’t see the broken pipe until I was on the ground. I hit very hard! After thousands of dollars of medical bills CIGNA insurance has done everything to make me go away. After turning in an insurance release… they stated I didn’t… I called the hospital and they had my release. Cigna also stated they didn’t have my current phone number after they talked with me on my phone… They sent a letter dated more than a week earlier than the postal stamp. The hospital called to conference call with both of us and after a week still didn’t reply. The association told me they knew about the broken sprinkler and they were planning on putting in lighting. Within a few days everything was fixed!
Cigna now tells me that the association put in lighting but not for safety reasons. They also say that I made the choice to take my dog to the bathroom in the middle of the night and that was my choice!. I have asked if they talked with other dog owners and neighbors that “know” how pitch black it was at times in that area! No answer… They have manipulated everything to get out of any kind of liability. I learned pretty early on to start getting things in writing and am glad! I am absolutely certain that everything is being done to make me just give up! Frrrrustrating… I have pre-existing medical conditions and this has caused me great stress! I think that’s the idea… they treat me like I’m some kind of criminal! They didn't ask me for names of people who were witness to the darkness and witness to them taking out sprinkler and putting in lights immediately?
