On 08-06-2013 I was driving on a 3 lane road in the lane closest to the median, a girl in a Honda was in the lane next to me (center lane), she darted in my lane to make a left turn and stopped (about a car length), it was raining and although I braked right away I was unable to avoid hitting her. There was a turn lane there, but she never used it, she was past that point in the road. I hit her around the center to somewhere on the passenger side of her bumper with my driver side headlight area, as she was not totally in my lane, she was stopped at an angle, her left side angled toward the turn opening. Once I pulled into the vacant lot that was at that turn area, I got out and asked her what she was doing, her reply was "I looked over my shoulder and I did not see you." The police came and they told her it was her fault. Unfortunately because the damage was less than $1500 they do not have to do a police report. When I got home, I received a call from my insurance company, where she was trying to file a claim against me. When my insurance company took my statement a few days later, I received a call the same day telling me they denied her claim. In the meantime I was calling her insurance company every day to see how things were coming along, I was not rude nor did I curse. I was told that I did not need to call every day....I told her that "I" would call as often as I felt necessary, and that if she would get up off her butt and take care of her business I would not have to call every day. That was on 08-09-2013, it is now 08-15-2013, I called on Tuesday and I called today. Today my adjuster was out of the office, so I talked to a gentleman (figuratively speaking, he was no gentleman), and I asked him why their investigation is going so slow, he told me that he felt that it was not going slow as it had only been 5 business days......if you do the math, it has been 7 business days, which is 9 days to long for an open and shut claim, their policy holder clearly made a mistake, and they are compounding it by dragging their feet trying to avoid paying. And to add further insult I get the impression that they think that when they finally do come to the conclusion that they have to pay that they are only going to provide a rental car for the time my car is in the shop. I am currently having to drive my car with a broken headlight lens ( light works fortunately) and a busted parking/turn signal indicator light (not working. I would replace them, but can't because the hood and fender are bent as to not allow room for new ones. Their adjuster told me my car is "drivable,"yes the motor runs, but if I were to go get it inspected, it would fail, which means I could get a ticket. They are just rude and too slow in handling claims.
