  • Claim Handling - Unjustified Accusations

My daughter is 8 years old and was riding her scooter (CALIFORNIA LAW STATES SHE IS STILL A PEDESTRIAN WHILE ON SCOOTER AND SIDEWALK) and was hit by my neighbor backing out of the driveway. Our neighbor had a blind-spot and did not see her due to the shrubs on her property. USAA is wanting to settle this claim at 60/40 due to the shrubs being a blind spot while backing out of the driveway. They also stated it was partially my fault because I was not supervising my daughter mind you she was next door not downtown and she was playing outside our neighborhood with her brother. Just makes me sick to think they are trying to pin fault on an 8 year old child. 21952. The driver of any motor vehicle, prior to driving over or upon any sidewalk, shall yield the right-of-way to any pedestrian approaching thereon. Police report states as well that the driver is at fault.
