  • Claim Handling - Denial of Claim

I have been a customer at BUSS HILL State Farm since 1997. Husband and wife coverage for multi car discounts. Unfortunately in 2008 and 2009 I had heart problems and kidney cancer. Fortunately my wife was able to make all our insurance premiums payments. We paid $7200+ in premiums since 2005, without ever having a claim. In 2011 I had a fender bender. Made a police report have photos of little or no damage. Police officer wrote report and did not issue any violations. However to our surprise the officer notified me and my wife we did not have insurance coverage. We called BUSS HILL’S office and immediately reinstated car with a check written by my wife. I filed a report of this fender bender and requested an estimate of claimed damage by other party involved in fender bender.
The other person in the fender bender went to Attorney Mark Shapiro, who has represented me in the past re: real estate. I think that would be a conflict of interest.
Mark Shapiro’s office was able to make a settlement with Metropolitan Insurance for $20,000+. I have never been notified of any loss of work, cost to repair, or any other pain and suffering this person claimed.
Now I am being sued for $20,000+ from a collection attorney and they have gone as far as getting a Summary Judgment against me personally. State Farm and Buss Hill refuse to represent me in this case claiming my policy lapsed. I however have cancelled checks for 2009 and 2010 for payments made to State Farm, again because of my illness in those years my wife made all payments requested by State Farm.
Buss Hill and State Farm accepted our payments over $1200 per year for 2009 and 2010.Now I'm being dropped from any assistance from Buss Hill and State Farm. I need help.
