I have a real beef with American United Life, (part of One America in Indianapolis, IN)! My father died 12/17/12. He had several life insurance policies. This one with AUL was through his work at Texas Tech University Health Sciences Center. I filed the claim through the HR dept of Texas Tech as instructed. I got a letter from AUL confirming receipt of the claim on 1/9/13. The letter was addressed "To the guardian of.." which I found odd as I am 46 years old. I phoned the next day. Was told birth date was wrong, Texas Tech corrected that same day. I called two days later and was told that despite the claims handler advising to pay the claim, because the amount was so large, the Vice President of the company had to approve. I call the next day and then was told that the claim was in "legal" because the death certificate listed my father as married and Texas is a community property state. My father married the wife in question only 8 months before he died and Texas has a rule called Inception of title that states the policy was his SEPARATE property because he bought it DECADES before he met the new wifey. I wait two more weeks and get Texas Tech involved and they state they will have the broker who sold the group policy look into it. I just got off the phone with them and the claim is STILL in legal and they won't tell me anything else nor let me speak to anyone. I told them I found out more about Texas law in 1 day than they have found out in TWO WEEKS! On top of that, if only 50% of the payout is in supposed conflict, then why won't they release the 50% that is NOT being contested? I believe that One America is delaying on PURPOSE to find some way not to pay out the $320,000.00 claim that is due my brother and I as LEGAL beneficiaries of our father's policy. At NO time was new wife on the policy and my father didn't co-mingle ANY of their finances. As well, my brother and I had NO PROBLEMS AT ALL with regard to the new wife when we were paid on a $5,000.00 policy and neither has my father's brother had ONE MENTION of the new wife and community property and HIS payout is half a million dollars! Something stinks in Indianapolis!
