On December 31, 2011 my son who had just turned 21 the month before was on his way to having dinner with his two best friends. They had planned to go out for dinner then go back home, park the car and walk 8 blocks up to town for the fireworks and festivities for New Years Eve.
On the way to dinner, they were traveling down Harper Avenue in clinton Township, just several miles from the house. The day before it had snowed alot. Even though Harper is a 4 lane street and plenty of businesses around the street lighting there is not adaquate at all. My son was trying to get into the right drive way and due to poor lighting and lots of snow my son did not see a man in the road. The man had either already been hit by another car or had fallen into the street. At that point my son hit him with the car.The elderly gentleman was pronounced dead at the scene. Needless to say my son and his two best friend were devastated ! My son has not been the same since that terrible day. He was cleared of any wrong doing. He had not been drinking, a breathalizer test was given
to him immediately when the police came to the scene of the accident. They held our car for over one month while they were further investigating the accident. The police officer that was the lead office on the case told me after the accident and the investigating into the accident that he couldn't belive how dark the street is over on Harper there, because there are so many businesses along that stretch. The officer felt so bad for what had occurred. He had talked with my son in length.
Following the accident, I phoned my insurance company the next business day after the holiday to let them know about the accident. I did what I was told to do whenever there is an accident. I called the insurance company and made a claim, explaining everything to them. They were aware that we had obtained an attorney, due to the fact that someone had been killed and having never been in such a circumstance my husband and I felt it was best to do so. The insurance company was aware of all this when I called to make a claim. I did what I was told to do.
As you know you can lead a horse to water but you can not make him drink. I wanted our son to go and get some conseling. From our priest or a therapist. I can't imagine what is going thru my sons head. I think he thought that he could get thru all of this alone.... without help. He has a hard time sleeping, its very difficult for him to talk to people, he hasn't dated since the accident. He is in a bad way. I can only do so much for him as a mother.
I phoned my Auto Owners over one month ago. To as them about my claim on the insurance regarding the claim #. I was told a claim agent would get back with me. Which he did eventually. Then I was told a whole lot of nothing. The agent told me there was never a medical claim made for my son. That a medical claim was only made on the man that was killed. Why would an insurance company make a medical claim of a deceased person and not the person that is alive???? Did they think every thing was going to be honkie-dorie for my son after such a horrible, horrible accident?? Then he preceded to tell me that they can't help my son, because it had been more than a year since the accident. No one told us there was a time limit. I didn't sign any papers closing out the original claim made. I never received any letter or information personally from the insurance company stating this. My original insurance agent told me that my son should see some one- a therapist.Then
she even expressed to me how one of her own family members had been in a similar accident. At that point, she nor anyone else ever said anything to me about having to open a claim (medical) for my son or that we had one year in which to do so. Young people think they can do anything! But this is something that my son has realized he can not get thru alone. He needs help.
At the point when the agent told me that there was nothing they could do,(that was almost one month ago), I told him I couldn't believe what he had just stated to me that a medical claim was open on a dead person but not for my son. What is up with that???? I expressed to him that I couldn't believe what he had just told me and that he needed to go back and talk with his supervisor or who ever it was he needed to talk to because his anwers to me were not acceptable and I couldn't believe what he said to me. I'ts been almost a month now and he has yet to get back with me. Myself and my husband have called our insurance agent and she expressed to me that she has also phoned this claim agent and she cannot even get intouch with him. Now can someone please shed some light on the subject! Can some one please help us. Help my Son ! I worked for a Surgeon for over 20 years and I know that insurance companies have to answer to the Insurance Commission when they screw up.
Someone please help us. My sons life depends on it!
