I am a member of the U.S. Coast Guard Auxiliary. I was given official orders to participate in a search and rescue mission. As such I become a member of the CG and a US government employee.
During the close of the mission I was loading my boat unto my trailer when I passed out from heat ehaustion and dehydration as determined my the Med Techs on site at the time. As a result, my truck and trailer struck a car and trailer also on the launch ramp. There was no personel injury. An on-scene CG officer recorded this accident and the CG paid for the repair of all damage including removing the boats and vehicles from the launch ramp.
The purpose of the Federal Tort Cliams Act,Amendment 28 U.S.C.S 26799(d)(1),is to remove potential personal liability of Federal employees from common law torts committed within the scope of their employment and instead seek remedy through an action in the courts against the United States. In short sue the Government.
Now I find this accident is listed on my driver record with both State Farm and 21st Century and is being used to increase my auto insurance premiums. Both companies state they have no liability in this, so now, I am paying hard earned money to these two companies for protection they deny having a responsibilty to provide.
